Restaurant and Bar Dispute Resolution

Commercial business disputes and regulatory challenges are an inescapable reality of being engaged in the hospitality sector, whether you own and operate an independent restaurant, bar, pub, nightclub, or franchised operation. For irrespective of the degree of legal safeguards implemented to protect your business, there remain areas of legal vulnerability that can provide the basis for commercial disputes (and oftentimes trial litigation). However, our law firm maintains a strictly limited and highly selective dispute resolution practice. We have purposefully limited our involvement to selective commercial disputes that are not intended to proceed to court litigation; such that we do not act as primary counsel for court-litigated trial matters (however, if called upon provide specialized legal support and strategic direction to primary legal counsel).

Resolving complex commercial disputes is rarely a straightforward task, given the multitude of variables, positions, and evidence subject to broad interpretation. Emotions routinely complicate commercial litigation, often hindering rational decisions and timely resolutions. While these competing pressures make litigation in the hospitality industry time-consuming and expensive, frequently rendering settlement prior to embarking on court litigation the prudent path, with our firm targeted to bringing focused, high-value insight to those selective matters where our specific legal involvement can make a meaningful difference.

Accordingly, our law firm restricts its dispute resolution practice strictly to highly specific commercial and regulatory issues in Alberta where we believe our specialized background provides clear value (and can be undertaken without court litigation). In turn, our dispute resolution practice is limited exclusively to: (i) disputes emanating from the purchase and sale of a restaurant or bar; (ii) corporate matters specifically related to unanimous shareholders agreements, joint ventures, and partnership agreements; (iii) internal business management and corporate governance issues, including director’s liability, officer’s liability, shareholder oppression claims, private investors, and investor fraud; and (iv) licensing, compliance, and dispute matters involving the Alberta Gaming, Liquor and Cannabis Commission (AGLC).

Our involvement in dispute resolution is intentionally restricted to these specific areas, where we act in a direct advisory capacity, as co-counsel, or as strategic legal support to your primary litigation team. As such, if you require specialized, limited-scope legal counsel or co-counsel support to tackle a complex commercial dispute or AGLC licensing matter in relation to your restaurant or bar, you may contact our law firm at 403-400-4092 or Chris@NeufeldLegal.com.
